Investigation key to landmark £300k victory against operators of controversial gossip website, securing justice for Irish couple and paving the way for future claimants.

Nardello & Co. is pleased to have been part of the team, working alongside Rory Lynch and Peter Barr of Gateley NI and barrister Peter Girvan, that unmasked the operator of controversial gossip website Tattle Life, now revealed as Sebastian Bond of the UK.

This follows a two-year legal battle and last week’s ruling by the High Court of Justice in Northern Ireland granting the application of Irish couple Neil and Donna Sands to lift reporting restrictions and name the defendants in their successful defamation and harassment case against the website owners. The couple was granted the largest libel damages award in Northern Ireland’s legal history after they argued they had been subjected to a campaign of harassment, invasion of privacy, defamation, and breach of data rights on the Tattle Life platform.

The case was complicated by the need to identify and track Sebastian Bond, who had transferred large sums out of UK bank accounts and fled to Asia.

Nardello & Co.’s Alan Kennedy and Finn Duggan were brought in by the Gateley NI legal team to unmask and track down the website’s elusive operator.

Rory Lynch, from Gateley NI, said: ‘The anonymous defendant was infamous for his evasive tactics in avoiding being unmasked. Many had tried and failed in the past to identify him. He even posed as a woman called Helen. So I knew this case required the gold standard of intel. So I went straight to Nardello [& Co.]  – the best of the best in that space. And they did not disappoint – Alan Kennedy and Finn Duggan in particular excelled’.

Alan Kennedy from Nardello & Co. said: “The investigation included the piecing together of numerous, disparate fragments of the operator’s multiple online identities, aliases, and personas, amassed over the course of two decades. Despite his sophistication, traces were left in the public record across the UK, including in the operator’s online digital footprint.

“Cases of anonymous harassment and online defamation are becoming increasingly common, complex and damaging. In today’s age of mis- and disinformation, this is a significant and welcome development, sending a clear message to malicious actors that anonymity cannot be relied upon and their actions will not go unchallenged.”

Technology entrepreneur Neil Sands, a plaintiff in this case said: “We undertook this case not just for ourselves but for the many people who have suffered serious personal and professional harm through anonymous online attacks on this and other websites.

“We believe in free speech, but not consequence-free speech – particularly where it is intended to, and succeeds in, causing real-world damage to people’s lives, livelihoods and mental health.  We were in the fortunate position to be able to take the fight to these faceless operators, and it took a lot of time, effort and expense.  Along the way we heard many stories from those damaged by the scurrilous commentary on the website and we are glad to be finally able to shine a light into this dark corner of the internet.  What we have established today is that the internet is not an anonymous place.

“The innovative technical and forensic work that Nardello & Co. undertook was pivotal to building our case. Without their resourcefulness and diligence this would not have been possible.”

This case has received significant media attention, including in the BBC, The Guardian, The Irish Times, The Daily Mail, The Telegraph, Cosmopolitan, and others.
