Expérience

  • When a client suspected that one of its competitors had failed to disclose potential conflicts of interest in violation of federal regulations, Nardello & Co. was asked to identify current or historical links between relevant parties and the competitor or its senior managers. Beth led a team that undertook an extensive review of corporate and securities filings, an analysis of litigation filings, a comprehensive media search, a review of the educational credentials and the professional background of the competitor’s senior management, a canvass of social media, and an examination of property records. Her team identified a number of connections between the parties; connections that our client presented to regulators as evidence of its competitor’s conflicts of interest. The competitor was ordered to pay millions of dollars in civil penalties and criminal investigations were opened regarding the firm’s business practices.
  • For various clients, Beth has led and participated in investigations into director candidate slates submitted by dissident shareholders, uncovering conflicts of interest, unreported histories of regulatory discipline or criminal conviction, reputational problems, and relationships with industry competitors
  • A technology company that suspected it had lost out on a billion-dollar government defense contract owing to the collusive machinations of its competitors and other third-parties hired Nardello & Co. to learn the truth. Our researchers found that certain politicians in charge of awarding the contract received large campaign contributions from the client’s competitors. In addition, journalists who had written articles critical of the client’s capabilities had professional or personal associations with executives at the client’s competitor firms.  Using these examples of improper influence and political corruption, the client sued the government, forcing it to re-open bidding for the contract.
  • On behalf of a woman concerned that her aging mother had transferred a significant number of assets to one of her household employees, Beth led a team that identified the assets held worldwide by the mother and her affiliated entities and verified their ownership. Beth also completed full background investigations of the employee and his wife, in the US and in their countries of origin, taking note of their financial status to determine if there were any indications of recent, unexplained wealth. After scouring records in the US, the Caribbean, and in Europe, Beth’s team provided counsel with the disposition of many of the subject’s assets as well as a list of the assets held by the employee couple. In addition, she outlined for counsel the history of the couple’s business and non-profit organization, highlighting the ways in which wealth could have been transferred without an outright asset sale.
